Terms of Service

1. Parties

These Terms of Service ("Terms") govern the sale of products through the website www.specialwallart.com operated by Titze Alex, with registered office at Via Cornat 37/, Fogliano Redipuglia, Gorizia, registered in Italy, VAT / Tax ID: 01254300310 (hereinafter referred to as "Seller").

2. Scope and Acceptance

These Terms apply to all orders placed by customers ("Customer", "you") through the website. By placing an order, you confirm that you have read, understood, and accepted these Terms. Orders are subject to availability and confirmation by the Seller. These Terms do not affect your statutory rights as a consumer under applicable law.

3. Products and Custom Items

Products offered are described on their respective product pages. Minor variations in color or details may occur compared to product images; such variations are not considered defects. The size of products may vary by up to half an inch from the size listed on the website. This is because the measurements are taken in centimetres and rounded off.

Products that are custom-made or personalized at your request (e.g., commissioned designs) are considered bespoke items and are handled under the provisions at Returns and Right of Withdrawal.

4. Prices, Taxes and Fees

  • All prices shown on the site are in EUR (Euro). As the Seller operates under the Italian “Regime Forfettario”, prices are VAT-exempt pursuant to Art. 1, paragraphs 54–89, Law 190/2014. No VAT is charged on invoices.
  • When shipping internationally, customs duties, import VAT, and any local charges may apply. These are always the Customer's responsibility, regardless of destination country (including EU countries). We cannot be held liable for any additional fees charged by customs authorities.
  • Shipping costs, where applicable, are displayed during checkout prior to order confirmation.

5. Order, Contract Formation and Invoice

  1. To purchase, you must complete the checkout process and submit your payment. An order confirmation email acknowledging receipt of your order will be sent to the email you provide. Such confirmation does not constitute acceptance of the order.
  2. The contract between the Customer and Seller is formed when we send a second email confirming that the order has been accepted and dispatched (“Order Acceptance”).
  3. Invoices (where applicable) will be issued in compliance with local tax rules. If you require specific details on the invoice, please indicate this at checkout or contact info@specialwallart.com.

6. Payment

We accept the payment methods displayed at checkout. Payments are processed by the selected provider; any disputes regarding payment must be raised promptly with the provider or with us. Orders may be postponed or canceled if payment cannot be verified.

7. Shipping and Delivery

  • Production times for made-to-order items: approximately 3–4 business days (estimate).
  • Production and delivery times are estimates and may vary depending on order volume and logistics. Delays caused by carriers or customs are beyond our control and do not entitle the Customer to compensation.
  • Customs duties, import VAT, and any local charges may apply. These are always the Customer's responsibility, regardless of destination country (including EU countries). We cannot be held liable for any additional fees charged by customs authorities.
  • Risk and title transfer to the Customer follows the rules specified at checkout and in the shipping policy (e.g., upon delivery to the carrier or the Customer as applicable under Incoterms).

8. Right of Withdrawal (Consumer Refunds & Returns)

Consumers within the EU: You have the right to withdraw from the contract within 14 calendar days without giving any reason, starting from the day you or a third party nominated by you (other than the carrier) acquire physical possession of the goods.

To exercise this right, you must notify us by an explicit statement within the 14-day period. After notification, you have an additional 14 days to return the goods.

Refunds will be made within 14 days from when we receive the returned goods or from proof of return shipment, whichever occurs earlier. Refunds will be issued using the same payment method as the original transaction unless otherwise agreed.

Exceptions and Limitations:

  • You do not have the right of withdrawal for products made to customer specifications (personalized or bespoke items), unless the product is defective or not as described.
  • Returned products must be in the same condition and packaging as received, with all labels attached unless otherwise agreed.
  • Return shipping costs are borne by the Customer unless the return is due to our error (e.g., wrong or defective item), in which case reasonable return costs will be reimbursed.

9. Faulty or Incorrect Items

If you receive a faulty, damaged, or incorrect item, please contact us within 48 hours of delivery at info@specialwallart.com with photos and a description. We will assess the claim and, where applicable, provide a replacement or refund in accordance with consumer protection laws.

10. Cancellation by the Seller

We reserve the right to cancel or refuse any order for reasons including, but not limited to: product unavailability, suspected fraud, pricing errors, or inability to obtain payment authorization. In case of cancellation after payment, any amount paid will be refunded in full as soon as possible.

11. Liability and Remedies

Subject to mandatory consumer protection laws, our liability for losses resulting from breach of these Terms is limited to the purchase price of the product(s) concerned. We exclude liability for indirect or consequential losses to the fullest extent permitted by law.

Nothing in these Terms limits any legal rights you may have as a consumer under applicable law.

12. Data Protection

Personal data provided during an order is processed in accordance with our Privacy Policy and applicable data protection laws, including the EU GDPR.

13. International Sales and Customs

  • The Customer is responsible for import duties, customs clearance fees, local taxes, or other charges imposed by the destination country.
  • Estimated delivery times do not include customs delays.
  • If a shipment is returned due to refusal to pay customs or import charges, the Customer may be responsible for return shipping costs and any related deductions from the refund.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy. For consumers residing in the EU, nothing in these Terms affects your statutory rights under mandatory local consumer protection laws.

The competent court for disputes is the court of your place of residence or as specified by applicable law.

15. Alternative Dispute Resolution

EU consumers may access alternative dispute resolution (ADR) procedures. More information is available at https://ec.europa.eu/consumers/odr/ .

You may also submit a complaint via the EU Online Dispute Resolution (ODR) platform.

16. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on this page. When changes are material, we will make reasonable efforts to notify customers by email or through a notice on the website in advance.

17. Miscellaneous

  • Force majeure: we are not liable for failure to perform obligations due to events beyond our reasonable control (e.g., natural disasters, strikes, governmental action, pandemics, transport disruptions).
  • Severability: if any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in effect.
  • No waiver: failure or delay in enforcing any right does not constitute a waiver of that right.
